Criminal cases: defendant's consent for video link first hearings

Question

Is it still a requirement in a criminal matter that the defendant’s consent be obtained prior to his participation in a live video link hearing?

Answer

No. From 14 December 2009, this requirement which was contained within section 57C(7) Crime and Disorder Act 1998 was removed by the Coroners and Justice Act 2009. Accordingly, it is no longer a requirement that the defendant consents to appear in court by way of video link from the police station.
