When should you use the small claims process?
The small claims process can be used for claims worth less than £5,000 (£1,000 for injury claims or outstanding housing disrepair claims against landlords). Small claims is a formal court process resulting in a legally binding decision, but it is less complex than the standard court procedure and is less expensive.

How can a solicitor help?
The small claims process aims to enable people to handle their own claims, but you may find it useful to seek advice from a solicitor before starting or responding to a claim, and you can also use a solicitor to deal with the claim for you if you wish.
Is there any cost associated with the small claims process?
You will incur court fees if you bring a claim, but you may be able to recover these from the person you have a dispute with if you win your case. If you appoint a solicitor to provide advice or assist you with your claim, he or she must explain to you at the outset how much their fee is likely to be. You will not be able to recover this legal cost from the other party, even if you win your case.
