The Law Society of England and Wales has welcomed a positive change in the European Parliament's draft report on the proposed Common European Sales Law (CESL). The change would limit the application of the new instrument to contracts involving distance selling (particularly online transactions).
Nevertheless, the Law Society remains unconvinced of the benefits of the proposed CESL, which could complicate cross-border transactions and increase complexity for businesses and consumers.
The Law Society continues to involve its members in order to provide constructive, practical input on the substance of any future EU instrument, should the initiative continue.
Law Society chief executive Desmond Hudson said:
'Although we remain unconvinced by the need for, or benefits of, the proposed Common European Sales Law, we are pleased that MEPs are taking account of our concerns and propose to limit its scope. We will continue to engage constructively with the policymakers to ensure that the concerns of our members are properly heard.'
