Defendant's duty of candour and disclosure in judicial review proceedings - Law Society response

The Law Society has responded to the lord chief justice's consultation the duty of candour in judicial review proceedings.

The Law Society has welcomed the move to clarify the duty within the civil procedure rules but is adamant that there is parity in the guidance provided to both parties. We also suggest explanatory guidance to help unrepresented claimants discharge their duty.
