Positive action
The Equality Act 2010 empowers employers to recruit or promote a candidate from an under-represented or disadvantaged group when deciding between two equally qualified candidates. This practice note sets out how firms can use these voluntary provisions to encourage the recruitment and promotion of people from different or disadvantaged groups. It sumarises the law relating to positive action; explains what the new provisions mean for practitioners and provides examples of how and when the provisions could be used.
