File retention: trusts
The original trust deed and any deeds amending its provisions or appointing new trustees are the property of the settlor and after the settlor’s death it is the property of the estate. They must be stored safely.
Increasing trust litigation, particularly where trustees are exercising decision making powers mean proper record retention is essential. This practice note is to help understand correct record retention.
