We are encouraging solicitors to send us examples of where unnecessary regulations could be removed and how regulatory processes could be simplified.
We are responding to all of the SRA's Red Tape Initiative consultations, which form part of the SRA's continuing commitment to regularly review its regulatory processes and procedures.
Our response to the first SRA consultation on this issue, in February 2013, highlights that we are encouraged by the intention behind this initiative. We are aware of several areas where bureaucratic processes hinder the business of practices and we are informing the SRA. Key areas include:
- Complaints - the need for the SRA to provide clarity around the wording on complaints in chapter 1 of the SRA Code of Conduct.
- Unpaid client account limit - set out in the Accounts Rules (rule 20) and needs to be re-assessed as a £50 de minimis imposes significant burdens on practices. We suggest that the de minimis amount be raised to £250.
- Accountants' reports - represent a cost burden on the profession but do not appear to be providing the SRA with useful or timely information in a format which is readily analysed.
