BIS consultation response: reforming the regulatory framework for employment agencies and businesses

In January BIS published a consultation on reforming the regulatory framework for employment agencies and employment businesses. The consultation also asked for views on enforcement and whether individual enforcement would be more effective than the current regime.

The Law Society's response:

  • suggests that the legislative definition of ‘employment agency’ could be improved
  • advises BIS to introduce a requirement for individuals to be told who is responsible for paying them, and
  • broadly supports ‘naming and shaming’ those who breach requirements.
