Unfair terms in consumer contracts: a new approach - Law Commission consultation

The Law Society welcomes the Law Commission issues paper on reform to the law on unfair consumer contract terms.

We have established a reference group of expert lawyers to formulate the response of the Law Society to a number of consumer law reform proposals published this summer, of which the Law Commission proposals are the latest.

Small print and hidden terms in consumer contracts are something most people have experienced in their lives. It is important for well functioning consumer markets that contract terms are clear and both contracting parties undertake obligations on an open and transparent basis.

The response highlighted the importance of reforms that result in a consumer contract regime which balances respect for party autonomy and freedom of contract but that also protects people from the unfair use of small print.
