Implementing the Trade Mark Directive 2015 - Law Society response
The Law Society’s Intellectual Property Law Committee has submitted a response to the IPO’s consultation on the proposed changes to UK law resulting from the Trade Mark Directive 2015, which is required to be implemented into UK law by 14 January 2019.
The Directive will update and replace Trade Mark Directive 2008/95/EC (the 2008 Directive) and seeks to further harmonise the conditions for obtaining and continuing to hold a registered trade mark, so that they are, in general, identical in member states.
The changes are largely technical in nature, but are likely to impact on anyone who applies for or owns trade marks and anyone who has an interest in other people’s trade marks.
