MHCLG consultation on development corporation reform – Law Society response

The proposals

The Ministry for Housing, Communities and Local Government (MHCLG) is consulting on whether and how legislation could make sure that a fit-for-purpose model exists for development corporations.

The technical consultation focuses on three areas:

  • involving the private sector
  • use of development corporations by local areas
  • comparable powers for development corporations

Our view

We recommend a more comprehensive review of the roles and functions of the different development corporations, so that there's clarity as to what they're expected to deliver on and what relationship they have with the local planning authority.

The need to future proof any development corporation means that local political realities should be reflected and parity of powers between planning authorities and adequate funding need to be put in place.

We recommend that academic research into the success or failure of development corporations inform any future developments.
