Ministry consultation on planning conditions - Law Society response

The Law Society's Planning and Environmental Law Committee recently responded to the Ministry of Housing, Communities and Local Government consultation on draft regulations intended to improve the use of planning conditions.

The Committee expressed concern that the new approach was overly prescriptive and risked, generating more appeals as a result of refusal or non-determination of planning applications. Such an outcome would defeat the object of the exercise.

Our response proposed alternative approaches to meet the government’s objectives.
