Draft Child Arrangement Programme report: Law Society response
The Law Society welcomes the Report of the Private Law Working Group on Child Arrangements Programme. We agree with the tone, content, and aims of the recommendations, and look forward to working closely with the Working Group to implement those changes in the near future.
The Report is extremely timely as the cuts to legal aid, the rise of litigants in person, the poor take-up of Alternative Dispute Resolution (ADR), and the cuts in court staff, buildings, and facilities create a new and difficult environment for all those involved in the system. The success of the recommendations in the report will depend, to a large extent, on funding issues and training. The Law Society also welcomes the focus on ADR as much of family justice takes place outside the court arena.
The Law Society would support a 'pilot' period of the recommendations contained in this report once they have been implemented, similar to that of the PLO. This would ensure that lessons can be shared and learnt, and issues addressed and rectified.
