National Planning Policy Framework reform – Law Society response

Planning policy provides the foundation for decision-making that affects communities, the environment and the economy. The National Planning Policy Framework must be clear, consistent and capable of being applied with confidence by all involved in the planning system in England.

The proposals

The Ministry of Housing, Communities and Local Government (MHCLG) is seeking views on a revised version of the National Planning Policy Framework (NPPF).

The NPPF sets out the UK government’s planning policies for England and how these are expected to be applied.

It sets a framework within which locally prepared plans can provide for housing and other development in a sustainable manner.

MHCLG is also seeking views on:

data centres and on-site energy generation
standardised inputs in viability assessments
reforming site thresholds

Our view

We underscored the importance of clarity, consistency and legal certainty in the drafting of these changes to the framework.

Where ambiguities or inconsistencies arise, they risk undermining the plan-led approach that the UK government seeks to strengthen.

What this means for solicitors

The proposed changes to the NPPF are wide-ranging and would affect how solicitors advise on planning matters across several areas.

Key proposals include:

a new format and structure separating plan-making policies and national decision-making policies
revised policies on housing, energy (including low carbon energy) and data centres
a revised glossary of definitions used within the framework
revised tests for the consideration of development of Green Belt land
