Independent appeals body for immigration and asylum appeals – Law Society response

We strongly oppose the government’s proposal to replace the First-tier Tribunal (FtTIAC) with a new independent appeals body for immigration and asylum appeals. The government should drop these plans and take a whole-systems approach that addresses the true causes of the backlog and delays.
The Home Office’s proposal to replace the FtTIAC with a lay appeals body – with no indication of how it would be independent – would damage our right to a fair hearing. This right is fundamental to our justice system, especially for those of us seeking safety.
Such fundamental reforms require proper consultation and engagement with the sector, providing sufficient information and time for reasoned responses.
Unfair treatment in our justice system harms us all. The government should focus on the Home Office getting decisions right the first time and acting fairly to support our collective good, not moving the goal posts.
The government should take a whole-systems approach that addresses the true causes of the backlog and delays by:
- stabilising asylum policy
- raising the quality of Home Office initial decisions
- improving efficiency in the current tribunal system; and
- funding legal aid properly
