Can conditional fee agreements be used in housing disrepair cases?

I’m acting for a client in a housing disrepair case. Am I able to use a conditional fee agreement?

Yes.

Section 58A of the Courts and Legal Services Act 1990 allows proceedings under section 82 of the Environmental Protection Act 1990 to be prosecuted under a conditional fee agreement, although they cannot provide for a success fee.

Section 82 cases are statutory nuisance cases, and this is the criminal provision relating to housing disrepair cases.
